1. Introductory provisions
Domelia, s.r.o. is an organisation with a tradition of providing services to entities operating in the labour market. The strategic interest of Domelia, s.r.o. is to ensure financial and economic stability, to increase the quality of services provided, to develop fair relations with partner organisations and to develop the company's reputation.
Enforcement of these interests is dependent on the continuous improvement of the level of management, quality and efficiency of the services provided, where we apply the latest procedures supported by information technology. We are aware that an integral part of their use is the attribute of security and protection of personal data.
The security policy of Domelia, s.r.o. has established the necessary and economically adequate measures to protect the assets of the information system, to protect persons and property and to introduce security mechanisms into the system of operating technologies.
The management of Domelia, s.r.o. is responsible for the correct assessment of risk and its effective management with regard to the protection of assets important for ensuring the functionality of the organisation. The primary objective of managing such risks is to prevent, manage and recover from security incidents.
In cooperation with experts, we have applied security measures to protect important assets falling within the scope of internal security, adapting them to the latest knowledge and needs of the organisation. In designing them, we have used technical and organisational measures that aim to:
- ensure the availability, integrity and reliability of management systems using the latest information technologies,
- protect sensitive business and personal data from loss, damage, theft, modification and destruction, and preserve the confidentiality of processed data,
- identify and prevent potential problems and sources of breaches.
Therefore, Domelia, s.r.o. has adopted appropriate technical and organizational measures to ensure the level of security in the processing of personal data (including the DPIA documentation) and has also developed a security project, which is regularly updated and defines the scope and method of security measures necessary to eliminate and minimize threats and risks acting on the information systems of our company.
Domelia, s.r.o. processes personal data of data subjects exclusively in accordance with Act No. 18/2018 Coll. on the protection of personal data and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC on the protection of personal data. Domelia, s.r.o. is the data controller of personal data.
Domelia, s.r.o. issues this document, which incorporates the basic principles of processing personal data when providing services through the website www.domelia.sk (hereinafter referred to as the "Website"). Domelia, s.r.o. reserves the right to amend this document, informing its business partners of the changes without delay by publishing the changes on the Website, indicating the date on which the changes take effect. All rights not expressly provided for herein shall be governed by the General Terms and Conditions of Domelia, s.r.o. and the applicable laws of the Slovak Republic.
This document complies with the applicable provisions:
- Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC on the protection of personal data (hereinafter referred to as the "Regulation"),
- Act No 18/2018 Coll. on the protection of personal data (hereinafter referred to as the "Act"),
- Act No 351/2011 Coll. on electronic communications, as amended,
- Act No. 22/2004 Coll. No. 128/2002 Coll. on State Control of the Internal Market in Consumer Protection Matters and on Amendments and Additions to Certain Acts, as amended by Act No. 284/2002 Coll.

2. Definition of terms
Personal data/personal data means any information relating to an identified or identifiable natural person (hereinafter referred to as "data subject"); an identifiable natural person is a person who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or by reference to one or more elements specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person;
The data subject is the person to whom the personal data relates.
Controller means the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data; where the purposes and means of such processing are laid down in Union law or in the law of a Member State, the controller or the specific criteria for its determination may be determined in Union law or in the law of a Member State;
A processor is a natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller;
Client means a natural or legal person who, in accordance with the terms and conditions of the Operator, publishes an Advertisement (Household) or Profile (Help) on the Operator's Website.
A Helper is a Client who uses the services provided on the Website in order to carry out work for the Household.
Household is a Client who seeks a Helper for their needs or the needs of family members.
Services are the products that Domelia, LLC provides to Clients through the Website. The Services provided to Clients in terms of the processing of personal data include: the ability through the Website to post an Advertisement, to post a Profile, to respond to a posted Advertisement, to respond to a posted Profile.
Advertising or Advertisement is a type of service provided to the Household, which is the publication of advertisement notices in text form with possible photo documentation on the Website; in particular, this includes jobs such as babysitting, domestic help, tutoring, care for the elderly, disability, home improvement and health and beauty jobs.
The publication of a profile is a type of service provided to the Helper, which is the possibility, through the Website, to create a profile that represents an offer for the provision of the following jobs: babysitting, domestic help, tutoring, senior care, disability care, home improvement and health and beauty work.
Processing of personal data means performing an operation or set of operations on personal data, in particular obtaining, collecting, disseminating, recording, recording, organizing, reorganizing or altering, retrieving, accessing, viewing, rearranging, combining, moving, using, storing, blocking, disposing of, disclosing, making available/providing or disclosing.
Disclosure is the transfer ofpersonal data to a third party for further processing.
Disclosure of personal data is the communication of personal data or the provision of access to personal data to a recipient who does not further process the personal data.
Consent of the data subject is a freely given, explicit and intelligible expression of the data subject's will by which he or she consents to the processing of his or her personal data on the basis of the information provided. Consent shall be evidenced in particular by a sound recording or a visual or audio-visual recording or by an affidavit of the person who has provided the personal data to the information system or by other reliable means. Written Consent shall be evidenced by a document confirming the provision of Consent. Evidence of Consent shall include, in particular, an indication of who has given the Consent, to whom the Consent is given, for what purpose, the list or scope of the personal data and the period of validity of the Consent.
Anonymisation of personal data is the act of modifying personal data in such a way that it cannot be attributed to the data subject to whom it relates.
3. Principles of processing and security of Personal Data
Personal data must be:
- processed lawfully, fairly and transparently in relation to the data subject ('lawfulness, fairness and transparency'),
- collected for specified, explicitly stated and legitimate purposes and not further processed in a manner incompatible with those purposes ('purpose limitation'),
- proportionate, relevant and limited to what is necessary in relation to the purposes for which they are processed ('data minimisation'),
- accurate and, where necessary, kept up to date; all necessary measures must be taken to ensure that personal data which are incorrect in relation to the purposes for which they are processed are erased or rectified without delay ('correctness'),
- kept in a form which permits identification of data subjects for no longer than is necessary for the purposes for which the personal data are processed ('minimisation of retention'),
- processed in a manner that ensures adequate security of the personal data, including protection against unauthorised or unlawful processing and accidental loss, destruction or damage, by means of appropriate technical or organisational measures ('integrity and confidentiality').
The controller is responsible for compliance with the above principles and must be able to demonstrate such compliance ("accountability").
The processing of personal data is lawful only if and to the extent that at least one of the following conditions is met:
- the data subject has consented to the processing of his or her personal data for one or more specified purposes,
- the processing is necessary for the performance of a contract to which the data subject is a party, or to carry out pre-contractual measures at the request of the data subject,
- the processing is necessary for compliance with a legal obligation of the controller,
- processing is necessary to protect the vital interests of the data subject or of another natural person,
- processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller,
- the processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require the protection of personal data, in particular where the data subject is a child.
Furthermore, the controller shall in particular:
- define the purpose of the processing of personal data prior to the commencement of the processing of personal data; the purpose of the processing of personal data must be clear, unambiguous and specific and must be in accordance with the Constitution of the Slovak Republic, constitutional laws, laws and international treaties to which the Slovak Republic is bound,
- determine the conditions of processing of personal data in such a way as not to restrict the right of the data subject provided by law, to obtain personal data exclusively for the defined or established purpose, it is inadmissible to obtain personal data under the pretext of another processing purpose or another activity,
- ensure that only personal data which, by their scope and content, are relevant to the purpose of the processing and necessary for its achievement are processed,
- ensure that personal data are processed and used only in a manner which is compatible with the purpose for which they were collected; it is not permissible to aggregate personal data which have been collected separately for different purposes,
- ensure that the personal data collected are processed in a form which permits identification of data subjects for no longer than is necessary to achieve the purpose of the processing,
- erase those personal data for which the purpose of processing has ended; after the end of the purpose of processing, personal data may be further processed only to the extent necessary for historical research, scientific research and development or statistical purposes. During the processing of personal data for the purposes referred to in the preceding sentence, the Data Controller shall be obliged to mark and anonymise the personal data.
4. Processing of personal data in the provision of services on the Website
Personal data in the case of Profile Disclosure
The Services provided by the Facilitator include the possibility to create a profile and publish it on the Operator's website via an online form filled in on the Website.
The profile contains data that is considered Personal Data under the Regulation and the Act. Therefore, this Personal Data may only be processed with the consent of the Data Subject. Before creating and publishing the Profile, the Data Subject declares that all the Personal Data provided by him/her is true and subsequently gives his/her consent to Domelia, s.r.o. to process his/her Personal Data.
The purpose of the processing of Personal Data is to assist the Helper as a job seeker to find a suitable job opportunity. Domelia, s.r.o. is entitled to disclose/provide the Personal Data contained in the profile of the Data Subject to its Clients (Households) on the basis of the Data Subject's consent and for the purpose stated in the previous sentence.
The Personal Data contained in the profile of the Data Subject shall be made available/provided to Households and Business Partners within the computer network of the Internet via the website of the Data Controller, for a period of 3 months from the date of consent to the processing of the Personal Data. After the aforementioned period, the Personal Data contained in the Profile will be inaccessible and stored in the Profile in case of its re-disclosure/provision by the Data Subject.
After a period of 3 years has elapsed from the date on which the Helper last logged in to his/her registration created on the website of the Data Controller, the data in the Profile will be definitively anonymised and further used exclusively for statistical purposes. The disclosure/provision of the Profile may be terminated and renewed at any time at the choice of the Data Subject. Upon the written request of the Data Subject, Domelia, s.r.o. is obliged to permanently delete the Personal Data.
The profile includes: at least one contact details (e-mail or telephone), the highest level of education attained, the type of service he/she is interested in providing, the location in which he/she is interested in providing the service, the years of experience, the frequency of the service, the amount of remuneration requested, the gender (for statistical processing purposes only), the month and year of birth, the language he/she speaks, whether he/she accepts animals, and whether he/she is a smoker. The provision of other data in the Profile is at the sole discretion of the Data Subject, Domelia, Ltd. does not require the provision of other data. Domelia, s.r.o. does not in any case require the Data Subject to provide data falling into a special category as defined in Article 9 of the Regulation or Article 16 of the Act. The processing of personal data is necessary for the effective provision of the service in question.
Personal data when publishing an advertisement
The Services provided to Households include the possibility to Publish an Advertisement on the Operator's Website via an online form filled in on the Website.
Personal data in response to a Published Advertisement
The Services provided by the Helpdesk include the possibility to respond or react to an Advertisement published on the Website of the Operator. Advertisements are published by Households. Only a Helper who has created a Profile on the Operator's Website or a Business Partner who has created a Business Profile on the Operator's Website may respond to an Advertisement.
The personal data contained in the Profile of the Data Subject is made available/provided to the Households and Business Partners within the computer network of the Internet through the Operator's Website.
The Profile contains data that is considered Personal Data under the Regulation and the Act. Therefore, this Personal Data may only be processed with the consent of the Data Subject. Before creating and publishing the Profile, the Data Subject declares that all the Personal Data provided by him/her is true and subsequently gives his/her consent to Domelia, s.r.o. to process his/her Personal Data.
The purpose of the processing of Personal Data is to help the Data Subject, as a job seeker, to find a suitable job opportunity. Domelia, s.r.o., based on the consent of the Data Subject and for the purpose stated in the previous sentence, is entitled to disclose/provide the Personal Data contained in the Data Subject's Profile to its Clients (Households) in response to a published Advertisement. The processing of Personal Data is necessary for the effective provision of the service in question.
Cookies
Cookies are small files that are downloaded to a device (computer, tablet, mobile phone, etc.) when using the Website. The operator uses cookies to examine the effectiveness of the Website. Cookies generally do not have any information used to identify individuals, but instead are used to identify the browser on a particular device. Cookies can be temporary or persistent, remaining on the device even after the browser is closed for the period of time specified in the cookie. These persistent cookies can be checked each time you visit the Website. The information we collect through the Website includes: the browser type, the Internet address from which the Website was accessed, the operating system of the device, the IP address of the device. To display more relevant advertisements, some cookies are set by a third party advertising system such as Google Adsense. This can be turned off in your Google account. It is possible to set your computer to refuse cookies, although in this case it is possible that some functions of the website will not work.
5. Rights of data subjects
The controller shall take appropriate measures to provide the data subject with all the information referred to in Articles 13 and 14 of the Regulation and any notices pursuant to Articles 15 to 22 and Article 34 of the Regulation relating to processing, in a concise, transparent, intelligible and easily accessible form, worded clearly and simply, in particular in the case of information specifically addressed to a child. The information shall be provided in writing or by other means, including, where appropriate, by electronic means. Where the data subject has so requested, the information may be provided orally, provided that the identity of the data subject has otherwise been established.
The data subject shall have the right to obtain confirmation from the controller as to whether personal data relating to him or her are being processed and, if so, to obtain access to those personal data and the following information:
- the purposes of the processing;
- the categories of personal data concerned;
- the recipients or categories of recipients to whom the personal data have been or will be disclosed, in particular recipients in third countries or international organisations;
- where possible, the period of retention envisaged for the personal data or, if this is not possible, the criteria for determining it;
- the existence of the right to require the controller to rectify personal data concerning the data subject or to erase or restrict processing, or the right to object to such processing;
- the right to lodge a complaint with a supervisory authority;
- where the personal data have not been obtained from the data subject, any available information as to their source;
- the existence of automated decision-making, including profiling.
The data subject shall have the right to have inaccurate personal data concerning him or her rectified by the controller without undue delay. With regard to the purposes of the processing, the data subject shall have the right to have incomplete personal data completed, including by providing a supplementary declaration.
The data subject shall be entitled to request Domelia, s.r.o. to erase the personal data concerning him or her. Any consent to the processing of personal data provided to Domelia, s.r.o. is revocable. Please send your request to the following e-mail address: [email protected]
The supervisory authority is the Office for Personal Data Protection of the Slovak Republic. The data subject is entitled to lodge a complaint with the supervisory authority.
